The following Terms and Conditions ("T&Cs") apply to this application and your acceptance for registration with Swim am byth programs and services. The T&Cs will apply until further notice. Any changes to the T&Cs will be notified in writing on the Swim am byth website – www.swimambyth.com.au ("Website").
Privacy Policy
Swim am byth is a division of WAT Sports Pty Ltd ("we, our, us") which is a family owned and operated organisation committed to the protection of our members privacy and personal information. Your privacy is protected under the relevant Privacy and Personal Information Protections in your State.
Personal information may only be disclosed in accordance with the exemptions provided under the relevant State legislation.
We will only use the personal details required on the registration form for administration purposes related to the service for which it is being completed and when we communicate information to you regarding any of Swim am byth’s programs, services or promotions that are deemed appropriate to your interests and needs and which may enhance your use of Swim am byth.
We will not make this information available to any third party unless necessary as part of the provision of the product/service.
Swim am Byth will, from time to time, conduct marketing and promotional photography and video recording at our venues and you are deemed to consent to allow our use of such on our website, social media, promotional materials and advertising.
If you do not consent to your image being used then it is your responsibility to notify us in writing at the time of registration so that we can note this on your file and ensure that we comply with your request.
By registering for a Swim am byth service/program you are providing us with consent to use the personal details provided for such purposes.
Payment & Fees
Fees are calculated on the number of classes available within the nominated period. Payment is required prior to the first class being confirmed. All payments are non refundable and non transferable.
Payment method is via Electronic Funds Transfer, Direct Debit, Card, Cash or Cheque.
Any changes to fees will be notified in writing on the Swim am byth website as well as to the last known email address a minimum of one month prior to the date the fee changes come into effect.
Discounts are available for families with multiple swimmers from the same family and for families who have swimmers attending multiple classes/week. For families who have referred someone to the Swim am byth Family, discounts are applied in the next payment period, discounts can not be backdated.
Class Suspension
Class suspensions are only applicable for ongoing Swim am byth memberships. Suspensions may be taken in one week blocks and a maximum of 2 weeks/calendar month are offered.
To process a suspension, we require at least 21 days written notice via the class suspension form on our website for your relevant location to make the relevant changes to the monthly swimming fees. We are unable to backdate suspensions or provide refunds for missed classes after the payment is due.
Class Cancellation
Class cancellations are only applicable for ongoing memberships. Cancellations may be processed at any time, however, we require at least one month written notice via the class cancellation form on our website for your relevant location to make the relevant changes to the monthly membership fees. We are unable to backdate cancellations or provide refunds for missed sessions after the payment is due.
When re-registering the time/day for your session will be based on the availability at the time of registration.
Missed Classes
Credits, make-up classes or refunds are not given for missed sessions where no notification has been provided. For missed classes due to public holidays or pool closures your monthly fee will be reduced accordingly.
In extenuating circumstances, credits may be considered for the following reasons:

Major illnesses

Hospitalisation

Moving house or relocation

Other extenuating circumstances
All applications for credits must be received in writing via email outlining the reason for the application, number of missed classes and providing relevant documentation such as doctors certificate.
If a credit is approved, you will receive written notification of the outcome with detailed instructions of any conditions associated with the credit.
Make-up Classes
Where notification is made through the family portal or via email at least 2 hours. prior to the class time a make-up class will be added to your account for future use.
Make-up classes can be redeemed through the family portal and can be booked up to 48 hours before the intended class is to take place.
Make-up classes are redeemable, where available through the family portal but are in no way refundable or eligible for account credit.
Make-up classes are only redeemable by current ongoing memberships and can not be used as a substitute for fees in any way.
Class Changes
Class occupancy is a major factor in determining whether or not a class time-slot will need to be cancelled. In the event that your chosen class is not 60% full, a Swim am byth supervisor may contact you to transfer to an alternate class.
We endeavour to provide you with the most consistent experience as possible; however there are occasions when lane and instructor changes are required. Please be advised that we cannot guarantee instructors from class to class. All instructors working at Swim am byth are fully qualified, and undergo regular training days to improve and maintain high levels of quality instruction. Please note refunds will not be given as a result of class changes.
Registration Process
Swim am byth has set registration procedures to assist you with attaining your preferred day and time for swimming classes. The registration processes is communicated on the Swim am byth website as well as to your current email address in our system.
If the registration process is not completed as outlined, the position in the program cannot be guaranteed. All registrations are only guaranteed once the upfront fee is paid in full.
